The Services may be made available or accessed by using third parties’ applications and/or in connection with third parties’ services and contents (including advertising) over which MERCURY-e has no control. MERCURY-e does not endorse any such third parties’ services and contents and, to the maximum extent permitted by applicable law, MERCURY-e shall not be held responsible for any Application, product or service of such third parties. The access to the aforementioned third parties’ services and contents is subject to the terms set forth in the terms and conditions of any such third parties respectively.

 

2. MERCURY-e and any parties related thereto have taken all reasonable precautions in offering their Services but make no representations or warranties about the content of the Application and the underlying software, including by way of an example but not limited to, its accuracy, reliability, completeness or timeliness. MERCURY-e shall not be liable for the accuracy or completeness of any content or other information notified to the user, nor for delays or interruptions of data or information stream, and does not guarantee that the Application and other Services will be available at all times. The user shall use the Application and other Services at his/her own risk.

 

3. You understand and agree that the MERCURY-e service is provided on an "as is" and "as available" basis. MERCURY-e makes no warranty that the MERCURY-e service will meet your requirements, allow you to access any particular programming, or that your use of the MERCURY-e service will be uninterrupted, timely, secure, virus-free or error-free; nor does MERCURY-e make any warranty as to the accuracy or reliability of any information obtained through the MERCURY-e service (including third party content), that any defects in the MERCURY-e service will be corrected or that the software or MERCURY-e service will be compatible with any other hardware or service. MERCURY-e shall not be liable for any damages to, or viruses that may infect the MERCURY-e service, the software, or other hardware. MERCURY-e and its suppliers disclaim all warranties of any kind, whether express, implied, or statutory, regarding the MERCURY-e y service or the software, including any implied warranty of title, merchantability, fitness for a particular purpose, or non- infringement of third party rights. Some countries do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the limitations in this agreement may not apply to you. In these countries, MERCURY-e ‘s liability will be limited to the greatest extent permitted by law.
